Nail Snap — Terms of Service (EULA)

These Terms of Service ("Terms") govern your use of the Nail Snap mobile application ("App"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Age and Eligibility

The App is rated 4+ years in most regions and is available in 173+ countries and regions worldwide. By using the App, you confirm you meet the minimum age requirement for your region.

1.1 Regional Age Requirements

While the App is generally rated 4+, specific regional requirements may apply:

• Brazil: Users must comply with Brazilian data protection laws (LGPD). Minors under 18 may require parental consent.
• Republic of Korea (South Korea): Users must comply with Korean data protection and privacy laws. Additional age verification may be required.
• European Union: GDPR compliance applies. Users under 16 may require parental consent (or lower age as specified by member state law).
• United States: COPPA compliance applies for users under 13.
• Other Regions: Additional local laws and regulations may apply. Please check your local requirements.

2. License and Use

• We grant you a personal, non-exclusive, non-transferable, non-sublicensable limited license to use the App in accordance with these Terms and applicable law.
• You may not reverse engineer, decompile, disassemble, modify, create derivative works, rent, sell, distribute, or exploit the App or any part thereof.

3. Apple App Store and Google Play Store Terms

3.1 Licensed Application and Applicable Terms

Nail Snap is made available through the Apple App Store and Google Play Store. Apps distributed via these platforms are licensed, not sold, to you.

3.2 Scope of License

ToughWing grants you a nontransferable license to use Nail Snap on:

• Any Apple-branded products you own or control (iPhone, iPad) as permitted by Apple's Usage Rules
• Any Android devices you own or control as permitted by Google Play Terms of Service

You may not: distribute the App over a network for multi-device simultaneous use, transfer/redistribute/sublicense the App, or if selling your device, you must remove the App first.

3.3 Apple's Role and Third-Party Beneficiary (iOS)

For users who downloaded the App from the Apple App Store:

• Your license to use Nail Snap is granted by ToughWing, not Apple
• Apple is a third-party beneficiary of Apple's Standard EULA and has the right to enforce it against you
• Apple has no obligation to provide maintenance, support services, or warranty for Nail Snap
• Apple is not responsible for:
  • The App itself, its content, or your use of it
  • Any claims relating to product liability
  • Failure to comply with legal or regulatory requirements
  • Claims under consumer protection or similar legislation
  • Intellectual property infringement claims
• All inquiries or complaints regarding the App should be directed to ToughWing at support@toughwing.app, not Apple

Note: The terms and conditions outlined in Apple's Standard EULA (available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) apply in full to iOS users.

3.4 Google Play Terms (Android)

For users who downloaded the App from Google Play Store:

• Your license is granted by ToughWing, not Google
• Google has no responsibility or liability related to Nail Snap or this Agreement
• Google Play Terms of Service apply to your download and use

3.5 Export Restrictions

You may not use or export the App except as authorized by U.S. law and the laws of the jurisdiction where obtained. The App may not be exported or re-exported:

• (a) Into any U.S.-embargoed countries
• (b) To anyone on the U.S. Treasury Department's Specially Designated Nationals List or U.S. Department of Commerce Denied Persons List/Entity List

By using the App, you represent you are not in such countries or on such lists, and will not use the App for purposes prohibited by U.S. law (including development of nuclear, missile, chemical, or biological weapons).

4. Account & Authentication

• The App may support sign-in with Apple/Google. You're responsible for keeping your credentials secure and for all activity under your account.
• If you suspect unauthorized use, contact support@toughwing.app.

4. User Content (Photos, Text, etc.)

• You own the photos and any content you upload ("User Content").
• To operate the service, you grant us a worldwide, royalty-free, non-exclusive license to host, process, reproduce, and display your User Content within the App and for service functionality only.
• You represent that your User Content does not infringe others' rights (copyright, privacy, publicity, etc.).
• Content that is illegal, infringing, hateful, pornographic, or contains malware is prohibited. We may remove such content and suspend/terminate accounts.

5. Prohibited Conduct

You must not:

• Violate any law, third-party rights, or these Terms
• Use the App for spam, fraud, distribution of harmful code, or security breaches
• Scrape, harvest, or attempt to bypass security or technical restrictions
• Interfere with or disrupt the App or connected networks

6. Subscriptions, Billing, Auto-Renewal

• Subscriptions: Certain features may require a monthly/annual subscription. Prices and plans are shown in-app.
• Auto-Renewal: Subscriptions renew automatically until you cancel. Charges are billed to your store account.
• Cancellation:
  • iOS: Settings → Apple ID → Subscriptions
  • Android: Play Store → Payments & subscriptions
  Cancellation takes effect at the end of the current period. No partial-period refunds (unless required by law).
• Billing/Refunds: Payments and refunds are governed by Apple App Store / Google Play policies.
• Trials: If offered, trials convert to paid unless canceled before the trial ends.
• Price Changes: We may change prices; changes apply to the next renewal and will be communicated in-app/store with reasonable notice.

8. Third-Party Services

The App integrates services such as Supabase (EU—Frankfurt), Google Maps/Places, Firebase/Google Analytics, and Adapty. Their availability may affect App features. See the Privacy Policy for how data is processed by these providers.

9. Intellectual Property

The App, software, design, text, graphics, logos, and trademarks are owned by ToughWing or its licensors and protected by IP laws. No ownership is transferred—only a limited license to use the App as set out here.

10. "AS IS" Warranty Disclaimer & Service Changes

The App is provided "AS IS" and "AS AVAILABLE." We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant uninterrupted or error-free operation or compatibility with any device/OS. We may modify, suspend, or discontinue features at any time; for material changes we'll try to provide reasonable notice.

11. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, special, consequential, punitive, or exemplary damages (including loss of profits, data, goodwill).
• Our aggregate liability for any claim shall not exceed the fees you paid to us for the App in the 12 months preceding the event giving rise to the claim.

Mandatory consumer rights remain unaffected.

12. Content & Data Deletion

• Photos: If bulk deletion is not available in-app, email support@toughwing.app with the subject "Delete my photos." After verification, we remove them from active systems within 30 days (backups may persist for a limited time).
• Analytics Opt-Out: Limit advertising identifiers in device settings and/or email us.
• For personal data rights, see the Privacy Policy.

13. Termination

We may suspend or terminate access if you breach these Terms or misuse the App. You may stop using the App at any time by uninstalling it. To stop charges, cancel your subscription per Section 6.

14. Updates to These Terms

We may update these Terms periodically. The latest version is available in-app and at toughwing.app/terms. Continued use after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of Turkey (excluding conflict-of-law rules). Courts and enforcement offices of Istanbul (Çağlayan) shall have exclusive jurisdiction. Mandatory consumer protections still apply.

16. Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, power/network outages, or third-party service failures.

17. Assignment

You cannot assign or transfer these Terms or your rights and obligations hereunder without permission. We may assign these Terms in the event of a business merger/acquisition.

18. Severability and Entire Agreement

If any provision is held invalid, the remaining provisions continue in effect. These Terms constitute the entire agreement between the parties regarding App use and supersede prior statements/understandings.

19. Language and Interpretation

These Terms may be published in other languages. In case of conflict, the English version prevails.
